Clients, Models, Students or Trainers Terms & conditions of photograph and video copyright
The Student, Model, Client, Customer or any individual or company using our hair extension, hair-loss, beauty services or training hereby agree to Grant
For consideration which they acknowledge the following: Agree to irrevocably grant to NAHM SPECIALIST SALON FRANCHISE Ltd ("Company") and Company's assigns, licensees and successors the right to use my/our/your image and name (when applicable) (“parties”) in all forms and media including composite or modified representations for all purposes, including advertising, trade or any commercial purpose throughout the world and in perpetuity. I waive the right to inspect or approve versions of my image used for publication or the written copy that may be used in connection with the images.
Release
Parties are agreeing to release Company and Company's assigns, licensees and successors from any claims that may arise regarding the use of parties image including any claims of defamation, invasion of privacy, or infringement of moral rights, rights of publicity or copyright. Company is permitted, although not obligated, to include my name as a credit in connection with the image.
Company is not obligated to utilise any of the rights granted in this Agreement.
This Agreement and Terms and conditions expresses the complete understanding of all the parties.
USE OF DIGITAL IMAGES
1. NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hair-loss Salon, Hair Extensions Training Academy and Diane Shawe retains copyright for all Digital Images taken of students, models or customers (parties) for the purpose of training material, promotional material or before and after shot confirmation.
2. NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hair-loss Salon, Hair Extensions Training Academy and Diane Shawe grants to students, models or personal customers (or your employer if you are registered as a customer, student or client who has used our services personally or on behalf of your employer), a nonexclusive, non-sub-licensable right to use your Digital Image and any derivatives or copies thereof on your personal computer or portfolio.
3. The Digital Image may not be shared by creating a library, Digital Image storage jukebox, network configuration or similar arrangement.
4. High-Resolution Digital Images may be used by NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hairloss Salon, Hair Extensions Training Academy and Diane Shawe on a worldwide and perpetual basis as a part of:
a. ADVERTISING and PROMOTIONAL MATERIALS (including packaging);
b. ONLINE or other ELECTRONIC DISTRIBUTION SYSTEMS (including web page design) and in BROADCASTS or THEATRICAL EXHIBITIONS;
c. ANY PRODUCTS (including for-sale products) or PUBLICATIONS (electronic or print); and
d. materials for PERSONAL, NONCOMMERCIAL use and TEST or SAMPLE use, including COMPS and LAYOUTS. including, for example: Website, Youtube, TikTok, social media plaforms, online and multimedia designs; Advertising and promotion campaigns, presentations and brochures; Book jackets and interior pages; Packaging for software, music albums, CDs and cassettes, and videotapes; Calendars, greeting cards and posters; Trade show displays, billboards and exhibits; and Products for resale in any quantity.
5. High-Resolution Digital Images may not be sub-licensed, resold or otherwise made available for use or distribution separately or detached from a product or web page. For example, High-Resolution Digital Images may be used as an integral part of a web page design, but may not be made available for downloading separately or in a format designed or intended for permanent storage or re-use by website users. Similarly, clients may be provided with copies of High-Resolution Digital Images (including digital files) as an integral part of work product, but may not be provided with High-Resolution Digital Images or permitted to use High-Resolution Digital Images separately. If such use is required, it is necessary for the third party to enter into a separate licence agreement with NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hairloss Salon, Hair Extensions Training Academy and Diane Shawe.
6. Pornographic use, use which would be defamatory or absent the consent of the model or use which is otherwise unlawful is prohibited.
7. If Digital Images featuring a person are used in a manner that implies endorsement, use of, or a connection to a product or service by that person, or a potentially unflattering or controversial subject, you must publish a statement which indicates that the person is used for illustrative purposes only.
8. One copy of the Digital Image may be made for backup purposes only, but may be used only if the original Digital Image becomes defective, or is destroyed or otherwise irretrievably lost. Except as specifically provided in this agreement, no Digital Image may be shared or copied.
9. The licence hereby granted is expressly subject to the condition that NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hairloss Salon, Hair Extensions Training Academy and Diane Shawe and all other business names Suppliers requires that a credit reading "Image © Copyright 2021 appear adjacent to the images sourced from NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hairloss Salon, Hair Extensions Training Academy and Diane Shawe and all other business names or clearly on an obvious credits page or screen. Images are not licensed for use in a downloadable or FTP format.
10. Use of the Digital Image must be in compliance with all applicable law, including, but not limited to, laws and regulations relating to currency and the law of moral rights. NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hairloss Salon, Hair Extensions Training Academy and Diane Shawe and all other business names Suppliers reserves the right to discontinue the use of any Digital Image for any reason and to elect to replace the Digital Image with alternate Digital Image. Upon notice of any discontinuance of a license for any particular Digital Image, you, and your employer and your client if applicable, agree not to use such Digital Image in the future.
11. The license contained in this agreement will terminate automatically without notice from NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hairloss Salon, Hair Extensions Training Academy and Diane Shawe and all other business names, model, client, customer, or your employer if you are licensing on behalf of your employer, fail to comply with any provision of this agreement.
12. Upon termination of this licence agreement, you, and your employer if you are licensing on behalf of your employer, must immediately
(i) stop using the Digital Images,
(ii) return the Digital Images and all copies of all of them to NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hairloss Salon, Hair Extensions Training Academy and Diane Shawe and all other business names, and
(iii) delete any Digital Images and all copies of all of them from all magnetic media and destroy all other copies or, upon request of NAHM Specialist Salon Franchise Ltd, Need a Hair Makeover Hair extensions & Hairloss Salon, Hair Extensions Training Academy and Diane Shawe and all other business names, return all such copies to NAHM SPECIALIST SALON FRANCHISE Ltd .
